Terms and Conditions

1. Acceptance of Terms

By creating an account, accessing, or using Waitlist Hero ("Service"), you agree to these Terms and Conditions and our Privacy Policy. If you do not agree, do not use the Service.

We reserve the right to modify these terms at any time. Continued use of the Service after changes constitutes acceptance of the modified terms.

2. Description of Service

Waitlist Hero is a web-based application that monitors fitness class availability at supported boutique fitness studios, sends notifications about open spots, and can automatically book classes based on user-defined preferences.

The Service requires users to provide their studio account credentials to access class information and make bookings on their behalf.

3. User Accounts and Credentials

Account Creation: You must provide accurate and complete information when creating an account. You are responsible for maintaining the confidentiality of your account credentials.

Studio Credentials: By providing your fitness studio login credentials, you authorize Waitlist Hero to access your studio account solely for the purpose of monitoring class availability and booking classes on your behalf. Your credentials are encrypted and stored securely using AES-256-GCM encryption.

Your Responsibility: You are responsible for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

4. Credits and Billing

Free Watches: New accounts receive a limited number of free watches to try the Service.

Pay-Per-Use: Beyond free watches, the Service operates on a credit-based, pay-per-use model. Each watch consumes one credit. Credits are purchased in advance and do not expire.

Payment: All payments are processed securely through Stripe. Credits are non-refundable once purchased.

No Guarantees of Booking: Purchasing credits or creating a watch does not guarantee that a class spot will be booked. Availability depends on the studio's class capacity and other users.

5. Acceptable Use

You agree to use Waitlist Hero only for lawful purposes and in accordance with these Terms. You agree NOT to:

• Share your account credentials with others
• Use the Service to violate any laws or regulations
• Attempt to reverse engineer, decompile, or hack the Service
• Use the Service in a way that could damage, disable, or impair the Service
• Use automated systems or software to extract data from the Service
• Use the Service to interfere with other users' ability to book classes
• Create multiple accounts to circumvent usage limits

6. Automated Booking

Waitlist Hero can automatically book fitness classes on your behalf. By enabling automated booking (Auto-Book mode), you acknowledge that:

• Classes may be booked on your behalf without your explicit review of each booking
• You are responsible for attending or canceling any classes booked through this feature
• Waitlist Hero is not liable if a booked class does not meet your expectations
• You must manage cancellations and late-cancel fees directly through your studio
• Booking confirmation mode is available if you prefer to approve each booking before it is made

7. Service Availability

We strive to provide reliable service but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control.

We are not responsible for classes you miss due to service interruptions, notification delays, or failures in the automated booking feature.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, STAR HERO AI LLC AND WAITLIST HERO SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

THIS INCLUDES BUT IS NOT LIMITED TO: MISSED CLASS BOOKINGS, LATE CANCELLATION FEES CHARGED BY STUDIOS, LOSS OF CLASS CREDITS AT YOUR STUDIO, OR ANY OTHER DAMAGES RESULTING FROM THE SERVICE'S OPERATION OR FAILURE TO OPERATE.

Our total liability to you for any claims arising from your use of the Service shall not exceed the amount you paid to Waitlist Hero in the twelve (12) months prior to the claim.

9. Third-Party Services

Waitlist Hero integrates with third-party booking platforms used by fitness studios. We are not affiliated with, endorsed by, or responsible for any booking platform or fitness studio. Any issues with your studio account, class policies, or cancellation fees must be addressed with the studio directly.

Payment processing is handled by Stripe. Your payment information is subject to Stripe's terms and privacy policy.

10. Intellectual Property

All content, features, and functionality of Waitlist Hero, including but not limited to text, graphics, logos, and software, are owned by Star Hero AI LLC and protected by copyright, trademark, and other intellectual property laws.

You may not copy, modify, distribute, or create derivative works without our express written permission.

11. Privacy and Data

Your use of the Service is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal information and studio credentials.

By using the Service, you consent to our collection and use of your data as described in the Privacy Policy.

12. Termination

We reserve the right to suspend or terminate your account at any time for violation of these Terms, fraudulent activity, or any other reason at our sole discretion.

You may terminate your account at any time by contacting support@waitlisthero.fit. Upon termination, your right to use the Service immediately ceases. Unused credits are non-refundable.

13. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be error-free, secure, or available at all times. We do not guarantee that any class will be successfully booked.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Ohio, United States, without regard to its conflict of law provisions.
